Important Changes for BC Homebuyers and Sellers: New Tenancy Notice Periods and Mortgage Implications

British Columbia recently implemented changes to the Residential Tenancy Act, impacting notice periods for tenants when a property is sold. While this aims to protect renters, it also presents unforeseen challenges for homebuyers, particularly those relying on mortgage financing. Changes to Notice Periods:

  • Effective July 18, 2024, landlords must provide tenants with four months’ notice (previously two months) to vacate if the buyer intends to occupy the property.
  • The notice period starts on the next rental period’s date.

  • Extended notice periods can exceed typical mortgage interest rate holds (usually 3-4 months). This creates uncertainty for buyers as rates could fluctuate before closing, potentially impacting their eligibility.

Additional Considerations:

  • Compensation for Tenants: Tenants receiving such notices are now entitled to two months’ free rent (previously one month).
  • Occupancy Clause: If the stated purpose of ending the tenancy (buyer occupancy) isn’t fulfilled within a reasonable timeframe, the landlord may owe the tenant up to twelve months’ rent.
